Acceptance of terms

These Terms of Service (hereinafter the "Terms") govern the use of the WatchScope mobile application and related services (hereinafter, collectively, the "Service"). The Service is conceived, developed and operated personally by its founder, as a private individual not constituted in corporate form and not operating with a VAT registration (hereinafter "WatchScope" or "we"). Any future transition to a corporate or sole-trader form will be communicated through an update of these Terms with reasonable notice.

By creating an account, downloading the app or using the Service you declare that you have read, understood and fully accepted these Terms. If you do not accept these Terms, do not install or use the app. For any communication relating to the Service you may write to support@watchscope.app; for personal data protection requests, to privacy@watchscope.app.

Service description

WatchScope is a mobile application aimed at collectors and enthusiasts of mechanical watches. The Service includes, among other things:

• management of your watch collection (recording brand, model, reference, photos, value and other attributes);
• timekeeping measurement tools via the device microphone (Quick Test, COSC session over the five ISO 3159 positions, hardware calibration);
• generation of PDF reports with test results and predictive diagnostics;
• the bilateral referral programme "1 free month for you, 1 for your friend" (see §6);
• the paid Pro version (see §5).

The timekeeping measurements produced by the app are estimation tools, they do not replace the opinion of a professional watchmaker and must not be used for commercial or insurance purposes without independent validation.

Account and requirements

To use the Service you must create an account by providing a valid email address and, where applicable, completing email verification or Google sign-in. You are solely responsible for the security of your credentials and for every activity that occurs under your account. You must be at least 16 to use the Service (or the higher age required by local law for consent to personal data processing); the Service is not intended for minors.

You undertake to provide truthful information and to keep it up to date. WatchScope may suspend or terminate accounts created with false information or used in violation of these Terms.

Licence to use

WatchScope grants you a personal, non-exclusive, non-transferable and revocable licence to install and use the app on your devices. All intellectual property rights relating to the app, logos, trademarks, source code, graphics and content remain the exclusive property of WatchScope or the respective owners. You are not authorised to:

• copy, modify, distribute, sell or sublicence any part of the Service;
• decompile, disassemble or attempt to extract the source code, except within the limits permitted by applicable law;
• remove or alter copyright notices, trademarks or other distinguishing marks.

WatchScope Pro subscription

WatchScope Pro is an optional subscription that unlocks additional features (unlimited COSC tests, hardware calibration, predictive diagnostics, unlimited inventory, PDF export, no ads). The subscription is managed by Google Play Billing through the RevenueCat platform:

• the available plans (monthly / yearly) and their prices are shown in the in-app paywall at the time of purchase;
• renewal is automatic at the end of each period, unless cancelled from the Google Play Subscriptions section;
• refund requests follow Google Play's policy: WatchScope does not handle refunds directly but can assist you by contacting Google on your behalf in documented cases;
• for EU/IT consumers the 14-day right of withdrawal provided by the Consumer Code applies; for digital purchases immediately enjoyable, this right is forfeited the moment you begin enjoying the premium content (e.g. running the first COSC test beyond the free limit), as provided by art. 16(m) of directive 2011/83/EU.

Referral programme

WatchScope offers a bilateral referral programme: for each friend who registers and redeems your code, you and your friend each receive 1 free month of WatchScope Pro. The following conditions apply:

• the programme has a cap of 12 rewards per account; once the cap is reached, the invitee still gets their month but the inviter no longer receives further months (the lifetime invites counter continues for statistical purposes);
• it is forbidden to self-redeem your own code, redeem codes from networks / devices previously associated with a deleted account, or circumvent by any means the anti-fraud measures described in the Privacy Policy;
• WatchScope reserves the right to revoke fraudulently obtained rewards, suspend or terminate accounts that abuse the programme, modify or terminate the programme at any time with reasonable in-app notice;
• deleting and recreating an account with the same email within 90 days of the previous deletion does not reset the referral counter nor remove any "already redeemed" status — this is an anti-abuse measure that does not constitute punitive treatment but a guarantee of programme fairness for other users.

Acceptable use

You undertake to use the Service in a manner consistent with the law and these Terms. The following are forbidden, by way of example:

• attempting to access other users' accounts;
• uploading unlawful, defamatory, offensive content or content that infringes third-party rights (e.g. photos of watches portraying identifiable persons without their consent);
• using bots, scrapers or automated tools to interact with the Service outside the intended modes;
• attempting to compromise the security of the app or the underlying cloud infrastructure.

Violations may result in the suspension or termination of the Service in respect of you without notice.

Third-party advertising

The free version of the app displays ads served by Google AdMob. The processing of advertising data (Android advertising identifier, IP address, ad interactions) is described in detail in our Privacy Policy. In the European Economic Area, the United Kingdom and Switzerland, personalised ads require your prior consent, which can be withdrawn at any time from Profile › Settings › Ad preferences.

Disclaimer of warranties and limitation of liability

The Service is provided "as is" and "as available", without any express or implied warranty beyond those mandatory under law. WatchScope does not warrant that the Service will be always available, uninterrupted, error-free, or that the measurements taken by the app will be as accurate as certified professional instruments.

To the maximum extent permitted by applicable law, WatchScope will not be liable for:

• indirect, incidental, consequential damages or lost profits arising from the use or inability to use the Service;
• buying, selling, valuation or insurance decisions made on the basis of the timekeeping measurements or value estimates produced by the app;
• data loss caused by malfunctions of the device, the operating system or third-party cloud infrastructure (Google, RevenueCat).

These limitations do not apply where the applicable mandatory law recognises consumer warranties and mandatory protections (in particular for EU consumers: liability for wilful misconduct or gross negligence, personal injury, conformity defects under the Consumer Code).

Changes to the service and to the terms

WatchScope may update the app, introduce new features, modify or suspend parts of the Service at any time for technical, security or commercial reasons. We may also update these Terms to reflect regulatory changes, improvements to the Service or new features. Material changes will be communicated with reasonable notice via in-app notification or email; use of the Service after the effective date constitutes acceptance of the changes. If you disagree with the changes, you may delete your account at any time (see §11).

Termination and account deletion

You may delete your account at any time from Profile › Profile › Delete account within the app. Deletion entails the permanent removal of data as described in the Retention section of the Privacy Policy. WatchScope may suspend or terminate your account, with or without notice, in case of violation of these Terms or legal obligations.

Governing law and competent forum

These Terms are governed by Italian law, without prejudice to the rules of private international law which may determine the application of a different law for consumers residing in other EU countries.

For disputes with consumers residing in Italy or the European Union, the forum of the consumer's place of residence or domicile is competent, as provided by the mandatory consumer-protection rules (Italian Consumer Code art. 66-bis; EU Reg. 1215/2012). For disputes between WatchScope and professional users (B2B), the Court of Lecce has exclusive competence.

EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

Final provisions

If any clause of these Terms is declared invalid or unenforceable by a competent authority, the remaining clauses shall remain in force. Failure to exercise a right provided by these Terms does not constitute a waiver of that right. These Terms, together with the Privacy Policy, constitute the entire agreement between you and WatchScope in relation to the Service.
